Terms of use

These terms govern your use of FiberScan (“the app”), published and licensed by Ingenio Productions LLC, a limited liability company organised under the laws of the Commonwealth of Pennsylvania, United States. By using the app you agree to them.

1. What FiberScan is — and is not

FiberScan is a data-capture and reporting tool for qualified asbestos professionals. It does not identify asbestos, does not replace laboratory analysis, and does not constitute professional, legal, or regulatory advice. Risk scores (including the HSG264 material assessment, the priority assessment and friability classifications), quantities (including AR measurements, which are indicative), and generated reports are aids to your professional judgement.

You are solely responsible for the accuracy, compliance and use of any survey, register or report you produce, for whether it satisfies your obligations under the regulations that apply to you, and for holding the certifications and licences your jurisdiction requires.

FiberScan is not accredited, approved or endorsed by HSE, the EPA, OSHA, UKAS, NVLAP, NATA, BOHS or Safe Work Australia. Naming a regulatory framework in the app or on this site describes the content the app carries, not an approval of the app.

2. Your account

You are responsible for safeguarding your login and for activity under your account. Accounts are for a single user. You may delete your account at any time from the app’s Settings.

3. Subscriptions (Professional)

FiberScan Professional is an auto-renewing subscription sold through the Apple App Store, offered in two lengths: one month at US$14.99 and one year at US$119.99. Those are the United States prices; the App Store sets the price and tax in your own storefront, and the price you will be charged is shown to you before you buy.

Payment is charged to your Apple ID; the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID subscription settings. Apple is the seller of record, and refunds and cancellations are handled through Apple rather than by us.

Professional removes the cap on the number of surveys, removes the watermark from generated reports, and adds the cross-survey register, cloud backup and sync, import and merge between your devices, and re-inspection reminders. On the free tier you may keep one survey at a time. Every capture feature is in the free tier.

4. Your content, and who is responsible for it

You own what you create. The surveys, photographs, floor plans and reports you produce are yours. Nothing here transfers ownership, and we do not use your survey content for any purpose of our own — not to improve the app, not to train anything, and not to show anybody else.

We hold survey content on your behalf, not for our own purposes. Much of what you capture is information about other people — the address of a building, its interior photographed, the client who commissioned the work. For that content you decide what is collected and why, and we act on your instructions: storing it, syncing it between your devices, returning it to you on request, and deleting it when you tell us to. In data-protection terms you are the controller of that content and we handle it for you.

Your own account is different. For the data we need to run the service itself — your sign-in details, your subscription entitlement, and diagnostics — we decide what is needed and we are responsible for it. The privacy policy sets out both, side by side.

We take the limited technical permissions needed to do the above and nothing further: to store, back up, transmit and reproduce your content so the service can return it to you. You are responsible for having a lawful basis to capture and store the site data and photographs you add, and for any permission your client’s premises require. If your client needs a written data processing agreement, ask us.

5. Acceptable use

Do not misuse the app, attempt to circumvent subscription limits, share a single account across multiple users, reverse-engineer it, or use it unlawfully.

6. Disclaimer & liability

The app is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Ingenio Productions LLC is not liable for any indirect or consequential loss, nor for any decision, deliverable, or regulatory outcome based on data produced with the app. Nothing limits liability that cannot be limited by law.

7. Intellectual property & third-party materials

FiberScan and its content are owned by Ingenio Productions LLC. You keep ownership of the surveys, photos and reports you create.

The material assessment scoring is derived from HSE guidance. It contains public sector information published by the Health and Safety Executive and licensed under the Open Government Licence v3.0. FiberScan is not produced, endorsed or approved by HSE. The priority assessment and the combined score band are FiberScan’s own prioritisation aids, not HSE classifications.

Reference photographs are used under open licences (Creative Commons / public domain); per-image credits are listed in the app under Settings → About → Image credits. Artex is a registered trade mark of BPB United Kingdom Ltd and Zonolite is a trade mark of W. R. Grace & Co.; all trade marks are the property of their respective owners and are used for identification only.

8. Governing law and where disputes are heard

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you use the app for your trade, business or profession, the state and federal courts located in the Commonwealth of Pennsylvania have exclusive jurisdiction over any dispute, and you submit to the personal jurisdiction of those courts.

If you are a consumer, nothing above deprives you of the protection of the mandatory consumer-law rules of the country where you live, or of your right to bring proceedings in the courts of that country. If you live in the United Kingdom or the European Economic Area, you may bring proceedings where you live, and we will bring proceedings against you only there.

Nothing in this section limits any right you have to complain to a regulator or supervisory authority.

9. Changes

We may update these terms; material changes will be reflected by the date above. Continued use after changes means you accept them.
